Steps Followed When Bringing a Massachusetts Medical Malpractice Lawsuit
If you call Curran Law Group, P.C. to discuss a Massachusetts medical malpractice case, you can expect the process to follow six steps:
Step 1: When you call our office to discuss a potential medical malpractice lawsuit, we will ask for some general information about you and we will ask a series of questions to get a sense of what took place and what injuries or harm you have suffered as a result. We will also answer any questions that you may have about your case and about what you can expect to happen next, if we decide to proceed with your case.
Step 2: If our law office does agree to proceed with investigating your case, we will then enter into an agreement with you that describes the work our medical malpractice office will do for you and the structure of our compensation. In any medical malpractice case, Curran Law Group, P.C. advances all costs, and we are only paid in the event we are able to secure a financial settlement or award on your behalf. In other words, we receive a percentage of the gross recovery. You, as the client, will lose nothing in the event there is no recovery.
Step 3: Once we have agreed to proceed, we will begin by gathering important information needed for your claim including, a more detailed medical history from you and a list of any physicians and/or hospitals that have provided medical care. We will then arrange to obtain any relevant medical records or diagnostic results. In almost every case, it is in these relevant medical records that we will discover the evidence needed to fully determine whether you may have a viable claim.
Step 4: If we believe that you have a viable medical malpractice case, we will then consult with an appropriate medical expert to discuss the claim and to identify both the strengths and weaknesses in the case. This will typically be a physician who practices in the same medical specialty as the negligent physician or medical provider. These medical experts are required in every case in order to establish the standard of care for the medical professional(s) who we believe caused the injuries or harm. Locating the right medical expert is a key factor that helps to establish liability and ultimately resolve a case.
Step 5: Our primary goal in any case is to obtain the highest amount of compensation possible for your medical malpractice injury claim. Out-of-court settlements in medical malpractice cases in Massachusetts are very rare, but despite this, we have successfully secured substantial settlements for our clients.
Step 6: If we are unable to settle your case, we will file your lawsuit in the appropriate court and will aggressively prosecute your medical malpractice claim until we recover fair compensation for your injuries whether it is through a settlement, arbitration or a trial.
