Failure to Diagnose or Treat Stroke
Failure to timely diagnose or treat a stroke can have disastrous consequences including permanent physical and mental impairment. Every year, hundreds of thousands of patients fall victim to preventable medical errors and other forms of medical malpractice in the U.S.
In fact, a survey conducted by the Harvard School of Public Health, revealed that approximately 25 % of people surveyed reported experiencing a medical error within the past five years.
Signs of stroke can often be mistaken for other less serious medical conditions leading to delays in vital treatment. In a recent Massachusetts case, a plaintiff entered the emergency room with complaints of nausea, dizziness and right hand weakness. The plaintiff was treated with Asprin, saline and Maalox with instructions to follow-up with her primary care physician.
One week later the patient returned to the ER by ambulance after suffering labored breathing, mental changes and weakness. The patient was ultimately diagnosed with a left middle cerebral artery infarct, a non-occlusive thrombus in the left common carotid artery requiring lengthy rehabilitation and long-term care.
After rehab, the patient continued to require a walker, and suffered with severe speech, reading and writing deficits limited use of her right arm.
Adequate testing and treatment in the ER would have reveal that the patient was suffering stroke. By failing to conduct proper testing including a brain MRI, echocardiogram and a cardiology and neurology consultations resulted in a delay of treatment leading to a poor medical outcome.
